Does Recovering On A Judgment Require A Great Deal Of Knowledge Of The Law

Does recovering on a judgment require a great deal of knowledge of the law?

Debt Collection Agency » Does recovering on a judgment require a great deal of knowledge of the law?

When a company must pursue other options to collect money that is owed to them, the best policy is to hire a national collection agency to handle the process. When a collection agency is hired, they do all the leg work for the company, even going about getting a judgment against the debtor. When a judgment recovery is processed, it is the only sure fire way to collect the funds that are owed to the company.

If a national collection agency is retained by a company, they will locate the debtor and attempt to make contact with that person or company. If the debtor refuses to pay, does not pay when promised or the national collection agency cannot locate them, the agency then sends the bill to the last known address and then continues the process of obtaining a judgment recovery for the bill. In order to get the judgment against the debtor, an attorney must draft the paperwork outlining the charges, then file the papers with the proper court in that specific area. After the papers have been filed with the court, the national collection agency then hires another outside source to serve the papers to the debtor. Each state has different laws regarding how debtors are served, although most states require the papers are served in person. It is in everybody's best interest that a professional process server serves the debtor with papers as they are trained to handle tough situations, and these situations can arise when someone finds out they are being sued, even if they owe the money. After the papers are officially served, the debtor has a certain amount of time, usually 20 days, to contest it to the court before the judge automatically sign off on it. Most debtors do not contest the papers since they know they cannot prove they don't actually owe the money. After the grace period is up, a judgment recovery is placed on them, this includes showing on the credit report for up to 7 years as a judgment.

Once the judgment recovery has been filed, the collection agency can now go about garnishing the wages of the debtor. This is where the collection agency receives a percentage of the debtors paychecks until the debt has been paid in full. In addition to the debt being paid off, the judgment also includes any charges incurred by having to obtain the services of a national collection agency as well as the charges for attorneys, process servers and any other costs associated with getting the debt paid.

It is the best policy to hire a collection agency to go about obtaining a judgment against a debtor as they are specially trained in the field of getting debts paid off, as well as saving the company time and money. Since all of the costs associated with paying off the debt are included in the fees the debtor pays, it technically does not cost the company money, instead, it saves them money.

We recommend letting a professional National Collection Agency handle your outstanding debts for the most effective and efficient no-upfront cost way to collect on monies owed to you.
